Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and current information when creating your account.
• Notify us immediately of any unauthorized use of your account.
• Not share your account credentials with others.
• Not create accounts using automated methods or false information.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Harass, abuse, threaten, or impersonate any person or entity.
• Distribute malware, spam, or unsolicited communications.
• Share content that is illegal, harmful, defamatory, or infringes intellectual property rights.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the Service, including servers, networks, or security features.
• Use the Service to transmit content that sexualizes minors, in any form. We report such content to law enforcement.
• Engage in any activity that could damage, disable, or impair the Service.

6. User Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display that content as necessary to operate the Service. You are solely responsible for your content and ensure it does not violate these Terms or applicable law.

7. Community Servers

Server owners are responsible for the content and conduct within their servers. Server owners must ensure their community complies with these Terms. We reserve the right to take action against servers that violate these Terms, including removal of content, server suspension, or account termination.

8. Voice, Video, and Screen Sharing

The Service includes real-time voice, video, and screen sharing features. You are responsible for obtaining consent from all participants before recording any voice or video session. Waypoints does not record or store voice/video data unless a participant explicitly initiates a recording.

9. Intellectual Property

The Waypoints software, brand, logo, and design are protected by intellectual property laws. You may not use the Waypoints name, logo, or brand to imply endorsement or affiliation without our written permission.

10. Disclaimers

The Service is provided 'as is' and 'as available' without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Waypoints and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim (which, for a free service, is zero).

12. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

13. Governing Law and Disputes

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms or the Service shall be resolved through negotiation. If unresolved, disputes shall be submitted to the forum of the user's domicile, in accordance with Brazilian Consumer Protection Code (CDC).

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, sending a notification within the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.
